Commissioner of Oaths
Introduction
A qualified lawyer who can administer an oath, take an affidavit or attest a signature where this is required by the court or for a specific type of document. Administering oaths is a reserved legal activity, by virtue of Part 3 of the Legal Services Act 2007 (LSA), which means that only a qualified practising lawyer can perform it. All of the main branches of the legal profession can administer oaths, including barristers, solicitors, notaries, legal executives, costs lawyers and licensed conveyancers.
When would you need a Commissioner for Oaths?
You may need a Commissioner for Oaths if you are:
Giving evidence on affidavit for court proceedings in Ireland
Making an affirmation, declaration, acknowledgment, examination or attestation for a variety of reasons, including court proceedings or for the registration of documents
If you need a Commissioner for Oaths, you should contact a legal professional and ask whether they provide this service to the public. You may need to provide the Commissioner with evidence of your identity, such as a passport or driving licence.
Process:
When you go to a Commissioner for Oaths they will:
Make sure you have a document that is written down
Check your identification
Establish that you have read the affidavit or document and understand what it says
Have you swear that the affidavit is true
Verify that the affidavit was properly sworn by completing a "jurat" which records your name, the place and the date.
In order to swear you will use a sacred text. The Commissioner for Oaths will have a variety of sacred texts available. If you are not religious then you may make an affirmation rather than an oath.
Rates:
The fees a Commissioner for Oaths can charge are given in the Rules of the Superior Courts (Fees Payable to Commissioners for Oaths) (SI 616 of 2003). They are: £10 per signature for verifying statements £2 charge for each exhibit that is attached to the document, up to a maximum of £30.
Change of Name Deed:
A deed poll is a kind of legal document used to prove a change of name.
In the U.K., changing your name is a legal matter. That means that there's no “official” place where you go to register your new name. In law, your name is legally established by usage. In theory you can just start using a new name, and gradually become known by it.
But to update your passport, driving licence, and most other official documents, you’ll need a formal document which proves that you’ve changed your name, and when you changed it.
A deed poll (or change of name deed) is a kind of formal legal document whereby you promise to give up your old name and use a new name for all purposes. It’s accepted by all government bodies in the U.K., including HM Passport Office and the DVLA. It’s also accepted by all banks and other organisations in the U.K.
